the infamous terms of use page [design]

Well, here it is. The .big blue design page. Are you excited yet? You're going to hate me for this, but I need you to read all this mumbo/jumbo prior to me showing you the templates. By entering the template section, you are agreeing to everything contained within this page, so you may want to read it, I tried not to make it too boring.


This is my design section.

I do designs for personal use, whether it be a full website, or just a diary template.

I'm not affiliated with any corporation, company, online resource center or organization. I do designs based on my time availability as well as my ever growing knowledge of web design techniques.

To start this endeavor I'm developing a few Diaryland templates. These templates are designed for view on IE 5.5+: 1024x768: 24-bit true color.

*I do check my designs using Netscape 6.2+, but for the sole purpose to ensure everything contained is visible.
*These designs are intended for 1024x768 screen area.
*24-bit true color = I don't use browser safe color palette, I'm just letting you know in advance.


What this all means:

I'll adjust, add, wrangle, edit, reform, twist, turn, bend and/or remodel any of the templates I make to fit your custom needs. However, I will only do so as long as I feel it keeps with the integrity of the template.

So, lets say you take the Blues Brothers template, and you want to add a big .jpg of Britney Spears below the .jpg of Jake and Elwood... that's probably not going to cut it.

BUT, on the same lines, if you wanted a Britney Spears template made that LOOKS like the Blues Bros. template, I'd be more than happy to accomodate.

One thing I'd like to get straight, I'll help anyone with almost anything based on the available time I have. So if you have anything you'd like me to help with, regarding any template or custom design, email me or sign the guestbook and I'll set up a mutually beneficial time where we could meet in a chatroom or chat program (yahoo, ICQ, AIM, MSN ) to work out the details. I'm extremely reasonable, but like everyone who does this as a hobby, I have to organize it around work and family, just as I'm sure you would and should do for me.

First and most important rule, please be courteous and patient. I'm not a professional web designer, the answers may not be readily apparent, I may have to research them. It may take a little time.


Payment:

Q: Do you have any free templates? I thought there were free templates?
A: They're all free silly rabbit, but it wouldn't make me feel bad if I got paid for any extra work I do.

Any payment recieved by me is for the development, implementation and support of design.

How payment works:

Basically, you be the judge, I leave it to your honest opinion as to how or if I should get paid based on the time, design, support, and/or professionalism I provide.

It's pretty simple. This is how I'm going to work it:

1. If you feel I don't deserve to get paid, and I do agree with you, well, that will be the end of it.

2. If you feel I don't deserve to get paid, and I don't agree with you, we'll discuss it professionally, and more than likely go our seperate ways without ever discussing any design or payment whatsoever. Meaning you don't ask me about design, and I won't answer you. This is not being bitter, this is me saying, I think I deserved to be paid for my work, and if I'm not going to be paid, I reserve the right to deny any future design support.

3. If you feel I do deserve to be paid, and I do agree with you. Well, this works out the best for me obviously.

4. If you feel I do deserve to be paid, and I don't agree with you...well, this just won't happen, so I wouldn't even consider this an option. ;)

I know this sounds very discretionary, in which the discretion is all mine. I agree with you, I also feel that everyone can be honest.

An example would be if you use a template, and I provide you about 20 minutes of support just making sure everything works, that's a situation I more than likely won't care if I get paid. Another example would be: if I spend 3 days completing a custom design or significantly alter a template to add say, chatbox, counter, guestbook form, notify form, etc., well, those are situations where I feel I should be paid.


The Nitty Gritty:

The Infamous Terms of Use.

1. On every design, custom or template, I will put a "design: .big blue" with a link to this design site. Under no circumstances should this be altered or removed, please. I do my best as not to have a screaming in your face BIG BLUE DESIGNS!!!!!!, that's why I always will put my link out of the way and keep it a resonable size. All I ask that if anyone asks, "Hey, neat design, where'd you get it?" you kindly point them my direction. Fair enough, right?

2. Payment Options. This is the part I'm not exceptionally skilled at. Look, here's the deal. $5.00 - $15.00 US. If there is a situation where I ask to be paid, this is what we can do. You can send me a check or money order, or plainly just ask me if there's anything I want, and I'll figure based on what you'd like to pay me as to what I may want. $5 US isn't a whole lot. So I'm thinking there may be some kind of thing I can join and people pay me and it goes into an account and I can save up 'points' to buy something. But as far as strict rules concerning this, I don't have any. Here's the breakdown.

$0 - $5 - Yeah, this is pretty much a donation as Dave is close to being considered a 'starving artist' at this point. Oh, and I got this cool template!
$5 - $10 - OK, Dave helped me add a guestbook form and counter on a pre-made template, he also helped me straighten a few bugs out.
$10 - $15 - That Dave guy designed me a site of my own, fully customized for exactly what I had in mind! or That Dave guy sacrificed 3 whole days just to help me out with one of the templates.
$15+ - I'm a philanthapist! If Dave were a scientist I'd be the first to sponsor him with a multi-million dollar grant. However, he merely runs this barely successful, web design, side-bit, type thing, and $15+ is an amount I can pay him without getting the IRS involved.

3. MOST IMPORTANT: I CANNOT REMOTELY HOST IMAGES FOR YOU. I'M SORRY. PLEASE NOTE THAT YOU MUST HAVE AN EXISTING IMAGE HOST PREPARED BEFORE I WILL PROVIDE ANY SUPPORT FOR ANY CUSTOM OR PRE-DESIGNED TEMPLATE.

4. Obviously, I hold copyright as it pertains to design structure. I do not hold all image copyrights.

5. Please, if you like a design structure that I use, or have any questions regarding anything I design, or want advice, or help with a design, please, please ask me. Like I've said before, I'm not the end all, be all, king of web design, but the best person to ask about how they did something, is the person who did it. I'll be glad to answer any questions anyone has. Most importantly, if there's anything in my code or html you see that I can improve upon, for sure please, please let me know, I'll be eternally grateful.
